Diane Huth vs. Bank of America
"Alert bill-supressed credit card customers by mail and phone when account overdue"

B of A and other banks must create a system to provide an effective alternative means of reaching consumers when digital notifications are not effective or stop working - the old fashioned way - by mail or phone. When I recently agreed to suppress my B of A paper bank statement, somehow my paper credit card statement was suppressed as well, without my being aware of it. I stopped receiving paper statements and thus did not know that I had a balance which was overdue until my credit limit was reduced by another card.
When I was told I had a delinquency on my B of A card, I immediately paid it in full - but it was too late. They closed my account and posted delinquency notices on all my credit reports, resulting in a major lowering of my credit rating.
I received no phone calls or letters or paper statements or notices advising of the delinquency.
There must be a fall-back notification method to prevent this from happening to others.
