siliq vs. AT&T

"Stop increasing the rate for data packages without proper notification"

  • siliq

As a smartphone user, I switched to ATT GoPhone back in 2011. The reason for using ATT's service is that ATT used to have following data packages:

    $5 for 10MB

    $15 for 100MB

    $25 for 500MB

When ATT was providing the Data Package, such service and rate can be automatically renewed.

ATT did not disclose on their website that such data services will be terminated. On the contrary, the "Auto Renewal" feature of such services has misled consumers into thinking that such data services will be provided on a ongoing basis at the same rate. As a result, I deposited $200 on the account balance out of my trust to ATT, along with the desire to save time by refilling the account less frequently.

Unfortunately, starting from April 18th, 2012. Such data packages are no longer available to 10¢ per Minute Plan GoPhone users. ATT terminated all the data packages to us, unless we subscribe to their $50/month plan. Moreover, the Auto Renewal of data packages has also been terminated by ATT.

ATT informed its consumers within very short time (The notice was sent out only two weeks).

As a result, ATT's wrongdoing has 1) breached the auto renewal contract; 2) significantly increased the rate from $15 a month to more than $60 a month, therefore disadvantaged its consumers; 3) very short notificatio period.

Additionally, as a customer, my experience of communicating with ATT has been frustrating so far. I have called ATT's Customer Service Department for three times. For the first two communications, ATT failed to give me any feedback. After my third phone call to ATT, they finally give me a feedback: my request of cancelling the account was denied by ATT without a justified reason from them.

My request is very simple: ATT should refund to me the full remaining balance ($218.64 as of April 20th) on my account. This is my money, and ATT failed to provide the service as advertises, and therefore they have no rights to keep the money. Unfortunately, ATT failed to satisfy that request.
