Lyndon Ebright vs. Apple

I found an iPhone APP on the iTunes store that sounded very useful. I downloaded it and when I tried to install it, I got a message indicating that IOS-4.3 is a minimum requirement. My iPhone is a 3G model running IOS-4.2.1. I have no plans to upgrade to a new model or enter into ANY stupid contracts. I'm grand-fathered on a very cheap unlimited data plan that I'm sure AT&T would love to see me drop.
SO, I contacted the APP developer (name NOT revealed to protect them) to see if they had an earlier version of this app. Here was their response:
"Apple's iTunes App Store will only allow developers to release applications that support v4.3 or newer."
In fact, Apple has already imposed this restriction on Apps that have already been installed!! I had the app "MyATT" and it was removed due to this IOS-4.3 restruction during an upgrade check.
SO, if you have a 3G... I foresee the day when any of the apps not factory installed will cease to function and will be removed from your phone. Kinda sucks.
If this is Apples policy, I see the day when my iPhone gets tossed in the trash can... and I'll buy a Samsung !!
